1. touchpoints Rewards Programme

1.1 These are the general terms and conditions, which apply to your membership of the touchpoints Rewards Programme ("Programme") and the award of touchpoints (" points "). The Programme is owned and operated by Eaton.

1.2 Any further specific terms and conditions of the scheme under which you are registered to receive “points” will be as notified on your registration for the Individual Reward Programme.

1.3 The Programme is limited to individuals who are aged at least 18 and are UK resident. To be eligible for the Programme, you must be a recognised alarm installer. Your participation in the Programme starts when you are notified in writing or email by EATON that your registration has been accepted and ends when your membership is terminated either by yourself in writing, or by EATON (see clause 14) or according to the specific terms and conditions of the Individual Reward Programme. Membership of the Programme is free or as otherwise specified upon registration.

1.4. All qualifying product must be purchased from EATON, and must be retail sales only, and not internet sales.

1.5  This is a non tax paid reward scheme and income tax will not be paid on your behalf by EATON on any Rewards you receive during the tax year . It is the participant’s responsibility to inform HMRC of the tax liability.

2. Programme Registration and Account

2.1 The Programme is limited to one account per individual, even if that individual has multiple email addresses.  Teams will not be allowed and pooling of sales under one individual will not be allowed. If it is found that this is taking place or has taken place the outlet will be disqualified from the programme.

2.2 In order to access and use the Programme, you will need computer equipment and telecommunications. You must provide, at your own expense, all necessary equipment and services (including telephone or Internet access) and pay all related third-party service fees.

2.3 In order to participate in the Programme, you agree to provide EATON with true, accurate, current and complete information as prompted by the Programme’s online registration form (“Registration Data”) and agree to maintain and promptly update the Registration Data as necessary to keep it true, accurate, current and complete. If you provide any untrue, inaccurate, out of date or incomplete information, EATON may suspend your account immediately and may refuse you all current or future use of the Programme.

2.4 Unless already assigned by the Programme, you must select an identification name (user name) and password as part of the Programme registration process. You are advised to memorise this information. You will need your user name and password to access your account, to redeem points and to update your Registration Data. You will be able to change your password in the My Account area of this Website, or request a re-set if you have forgotten your log-in details.

2.5 You agree not to use any offensive or obscene language in your identification name, password, e-mail address, aliases, e-mails or any other communication. EATON reserves the right to immediately suspend or terminate your account if you breach these terms and conditions and may refuse you all current and future use of the Programme.

2.6 You are responsible for keeping your identification name and password confidential. You are solely responsible for all activities that occur under your e-mail address, user name and password, including any unauthorised activities. You agree to immediately notify EATON of any unauthorised use of your identification name and password or any other breach of security related to the Programme or the Programme’s website www.touchpoint-online.com (“Website”) and ensure that you effectively exit from your account at the end of each session.

2.7 You agree to comply with all applicable local and international laws and regulations in respect of your account.

2.8 EATON is entitled to act on instructions received under your identification name and password. EATON will not be liable for any credits or debits made to your account by another individual who uses your password or for any loss or damage arising from your failure to adequately safeguard your identification name and password.

2.9 You consent to EATON employees, and the employees of any third party providing services to EATON in connection with the Programme, being able to access your account and records to investigate complaints or allegations of abuse. If this occurs, EATON shall not disclose the existence or occurrence of such an investigation unless otherwise required by law. EATON complies with court orders and cooperates with governmental agencies and under these circumstances your account information may be shared with or without your knowledge.

2.10 Each person can only claim for their own sales.

3. How to Earn Points

3.1 You will earn points according to the terms and conditions of your Individual Reward Programme. You can earn points and win additional prizes by participating in various activities on the Website. Descriptions of these activities (which may include on-line puzzles, completing polls or surveys and participating in partner offers, as well as submitting claims for sales of “qualifying” Eaton products) and the number of points awarded per activity are outlined in the Website. The qualifying activities and the points available are subject to change, modification, addition or deletion from the Programme by EATON at any time and without prior notice.

3.2 Claims for all qualifying sales must be made within 30 days of the end of the month in which they were sold. Claims for sales must be made on the Website. All claims will go through a validation process before being available to ‘spend’ on the Rewards on the Website. Immediately your claim is submitted, points will be shown in your account as ‘Pending’ until they have been validated and set to ‘Available’. Certain claims may also require you to complete training modules and achieve the pass mark before the points are set to Available, or before you will be eligible to earn any additional Rewards or Prizes.

3.3 By entering your email address into the Website, you agree that you will receive personalised e-mails, information and offers from EATON and/or its partners ("Partners") or as otherwise specified by EATON via electronic mail, the Internet, physical mail and other communications in any media. You also agree that activity by you regarding the information received may provide you with the ability to earn points.

3.4 From time to time, the Programme may send you messages that do not carry the ability to earn points. Notwithstanding the foregoing, EATON will use reasonable endeavours to you inform you when you have the opportunity to earn points.

3.5 On occasion, EATON and/or its Partners may allow you to earn additional points or other prizes via special offers. The ability to earn additional points and the amount of possible additional points will be stipulated in each special offer. You must comply with the terms of each special offer to earn any such additional points.

3.6 You acknowledge that you may not be eligible to receive certain offers. If you are sent or receive an offer in error, EATON reserves the right to debit your account for the points erroneously credited.

3.7 EATON shall make the final determination, in its sole discretion, as to whether a qualified activity has been satisfactorily completed and points may or may not be earned for such activity in your account.

3.8 You may be given additional points if EATON determines, in its sole discretion, that such points should be given.

3.9 You may view a summary of, and confirmation of, your points (including points earned and redeemed) on the Website. Points may not be transferred to any other account.

3.10 Points have no cash value, are non-negotiable, non-transferrable and cannot be redeemed in whole or in part for cash.

4. Rewards

4.1 A list of reward products which are included in the Programme ("Rewards"), are detailed on the Website.

4.2 The availability and number of points required for Rewards is subject to change without notice at any time.

4.3 Unless stated otherwise the points values for all Rewards shown in the Website include applicable Value Added Tax, handling and shipping.

4.4 This is a non tax paid reward scheme and income tax will not be paid on your behalf on all Rewards you receive during the tax year, by EATON. It is the participant’s responsibility to inform HMRC of the tax liability.

4.5 Products are supplied in accordance with EATON's standard specifications but EATON reserves the right to make improvements and modifications in such specifications without prior notice as it or its suppliers consider desirable in the circumstances.

4.6 Every effort is made to ensure that the online Rewards pages are accurate. However, neither EATON, nor any other Eaton group companies nor its agents are responsible for any typographical or pricing errors on the Website.

4.7 EATON may offer special promotional Rewards from time to time.

5. How To Redeem points

5.1 You can use points to order any Reward listed in the Rewards pages of the Website. Select the item you wish to receive, check that you have sufficient points to order it, place the item in your online cart. Select or enter the address for delivery, and submit your order. Please allow up to 28 days for delivery.

5.2 When ordering you must have at least the number of points needed for the Reward you select.

5.3 Points shall immediately be deducted from your account upon placing the order, and held until the Reward is dispatched.

6. Rewards, Availability and Delivery

6.1 These terms and conditions shall govern your ordering from EATON through the Programme of any Reward.

6.2 Eaton offers a variety of Rewards through the Programme and may update, revise or discontinue any Rewards offered at any time, in its sole discretion.

6.3 Quantities of Rewards are subject to availability. In the event of a shortage, EATON may allocate sales and deliveries of such Rewards in its sole discretion and/ or may offer you an alternative product.

6.4 Changes or differences between the marketing materials describing the Rewards through the Programme and what Rewards are shipped are possible.

6.5 Any order for Rewards placed by you through the Programme shall be considered to be an offer by you and, therefore, subject to acceptance by EATON. No acceptance of your offer shall be deemed to be given by EATON until shipment by EATON or its designee of such Reward.

6.6 If you purchase a Reward that includes any software, then such software (including pre-loaded software contained in hardware) is provided subject to such software's end user license agreement and you agree to be bound by any such agreement.

6.7 EATON makes every effort to ensure that Rewards described in the Website are available. However, if after 28 days the Reward you have ordered is still not available, we will let you know by telephone, email or letter and cancel your order and re-credit the points to your account, or equally you are allowed to advise us that you do not wish to wait for the item and can cancel your order, provided it has not been despatched.

6.8 Rewards will be shipped to your registered Programme address within the UK, or to an alternative UK address if you provide this at the time of ordering. Rewards within a single order may be shipped separately.

6.9 Title (other than in the case of software, which shall remain with the applicable licensor) and risk in Rewards shall pass to you upon delivery to your registered Programme address.

6.10 Unless you have been notified of a delay in the delivery of the Reward in accordance with clause 6.7 above, if the Reward has not been delivered within 28 days from the date of order, please send an email using the Contact page of this Website, quoting your order number, or email a reply to the email you received when ordering.

6.11 In the unlikely event that a stated price for a Reward or the number of points required is incorrect, then the following applies:

6.11.1 If the correct number of points needed for purchase of the Reward is lower than the EATON points requirement listed, EATON will deduct the lower amount and ship you the Reward.

6.11.2 If the correct number of points needed for the Reward is higher than the points requirement listed, EATON may, in its sole discretion, either (i) contact you to advise you of the points pricing error, and offer to take the additional points from your account; or (ii) cancel the order for the Reward and notify you of such cancellation, and refund the points.

7. Guarantee

7.1 EATON makes no guarantees or warranties in respect of a Reward other than (i) those stated in the guarantee card(s) accompanying the Reward; or (ii) where the Reward is shipped without a guarantee card, the minimum statutory warranty is applicable. This shall not affect your prevailing statutory rights under any applicable national law.

7.2 Any faulty and/or damaged Rewards will be dealt with in accordance with the applicable guarantee (if any) and the return conditions set out in Section 10 below.

8. Cancelling an Order

8.1 You have a right to cancel your order for a Reward within 48 hours from the time the order is made provided that:

8.1.1 you notify EATON by emailing using the Contacts page of this Website, or by replying to the email you received when you placed your order..

9. Faulty or Damaged Rewards

9.1 All Rewards and their packaging leave our warehouse in good condition. For Rewards that appear to have been damaged in transit, for example if the outer packaging appears to be damaged, please refuse delivery and contact info@touchpoint-online.com within 24 hours. Do not sign the documents to say that you have received it.

9.2 In the unlikely event that you find that the Reward is faulty within 7 days following the date of delivery you may return the faulty Reward for replacement.

9.3 For Rewards, which are faulty, within the meaning of the accompanying guarantee (if any), please follow the instructions given in the relevant guarantee (if any) or on the Rewards or their packaging.

10. Returning Rewards

11. Expiry of Points (points)

11.1 Points shall be earned during the programme for each qualifying activity that you complete.

11.2 Points shall only be Available to spend for a set period after the end of the Programme. Please refer to the FAQs section of the Website for the specific current deadlines. Any points that are not redeemed during this period shall be forfeited at the end of that period.

11.3 If EATON terminates the Programme you will be advised via email and will have a period of 3 months from the date of the notice of termination of the Programme to redeem all your Available points. Please refer to the FAQs area of the Website for any updates to these deadlines.

11.4 EATON reserves the right to close an account where there has been no activity for 6 months or more.

11.5 All points are automatically forfeited if you elect to terminate your membership of the Programme.

12. Customer Data

12.1 EATON (expressly including any affiliates of Eaton) may use the personal data provided by you (“Personal Data”) to advise you of, offer and supply goods and services, and for other marketing purposes as laid out in the Website’s Privacy Policy. Personal Data will assist EATON in further improving its services. EATON may not be able to provide certain services without such Personal Data.

12.2 You agree that: Personal information which you supply will be processed by Eaton, and its third party service provider for the purposes of administering this promotion. If you agree, we would also like to use this information to advise of offers and supply products and services which may be of interest to you from Eaton and other Eaton companies worldwide.

13. Security

13.1 Whilst you are the holder of points you are responsible for their security. EATON is the owner of points and they remain EATON's property at all times.

13.2 It is your responsibility to keep secure any information that might establish your identity and enable anyone to use your points. EATON cannot be held responsible if a person is able to use points through possession of your details.

13.3 Please make sure to keep your account address up to date and accurate to minimise security risks. EATON cannot be responsible for mislaid post and EATON recommend that you use recorded delivery when sending us important documentation.

14. Termination

14.1 EATON reserves the right to vary the Programme and these terms and conditions or terminate the Programme at any time.

14.2 Your account may be terminated as follows:

14.2.1 You may terminate your membership of the Programme for any reason at any time by sending an email on the Contacts page of the Website. All points are automatically forfeited if you elect to terminate your membership of the Programme.

14.2.2 EATON may terminate your membership, password, account or use of the Programme effective immediately and without prior notice, for any reason, including, without limitation, failure to provide accurate Registration Data, lack of use, or if EATON believes that you have breached or acted inconsistently with these terms and conditions in so far as they apply to you.

14.3 On termination by either you or EATON:

14.3.1 EATON may immediately deactivate or delete your account and all related information and files and/or prevent any further access to such files or the Programme.

14.3.2 Your right to use the Programme ceases immediately.

14.4 You agree that EATON will not be liable to you or to any third party for termination of your account or access to the Programme.

15. General

15.1 You acknowledge and accept that the name "Touchpoints" is owned by EATON and that you have no right or interest therein. You agree that all rights, title and interest and other intellectual property and proprietary rights in the Programme and the Website shall remain in EATON, its licensors and suppliers. No rights, title or interest in or to any trademark, service mark, logo, trade name or other corporate identification marks or proprietary right of EATON is granted.

15.2 The Programme is made available at the full discretion of EATON who is responsible for the Programme operation and Reward fulfilment.

15.3 Any waiver by EATON of its rights under these terms and conditions to require compliance with any of the provisions shall not act as a continuing waiver of such rights or as a waiver of such rights in the future.

15.4 These terms and conditions do not affect your statutory rights.

15.5 These terms and conditions are subject to English law.

15.6 The provision by EATON of a link to any other third-party website or Internet location is for your convenience only and does not signify EATON’s endorsement of such other site or location or its contents and you agree that we are not responsible for the content or availability of any such sites.

15.7 You agree to indemnify and hold harmless EATON (including its parent, subsidiaries, affiliates and their respective officers, directors, employees, agents, licensors, suppliers or other partners) from and against any and all claims, losses, costs, fees (including reasonable professional fees), damages and expenses that such parties may incur or suffer as a result of, due to, or arising out of your breach (or anyone acting under your account or password) of these terms and conditions or the use or misuse of the Programme by you (or anyone acting under your account or password), or the breach of any rights of another by you (or anyone acting under your account or password).

15.8 You agree that participation in and use of this Programme and the Website is solely at your own risk.

15.9 To the fullest extent permitted by law, EATON excludes all warranties and representations, express or implied, including but not limited to any implied warranties of satisfactory quality, fitness for any particular purposes, security, accuracy, non-infringement or compatibility with any computer hardware or other equipment, operating system or software programme.
